What Can I Do If My Application Is Denied?

- Request for reconsideration: It is simply that — a request to have the Social Security Administration (SSA) reconsider your original application. At this stage of the appeals process, you should be able to get clarification and gain insight as to why your initial application was denied.
- Hearing: If your request for reconsideration is denied, you have 60 days to request a hearing before an administrative law judge (ALJ). At your hearing, you can present new evidence that supports your disability.
- Appeals Council: If your benefits claim is denied at the hearing, you can have the Appeals Council review the decision. The Appeals Council will approve your claim, deny your claim or return your case to the ALJ for further review.
- Federal court: If the Appeals Council denies your claim, your final option is to take your claim to federal court.
It is important to stay positive. Many individuals assume that a denial at the application stage is the final decision. As described above, this is simply not the case. There are many steps in the appeals process.
