September 12, 2001. The morning after the Twin Towers of the World Trade Center were destroyed in a terrorist attack, a historical period referred to as the“Post 9/11 Nuclear Aftermath” began. Fires burned. Smoke filled the sky. Fliers with smiling faces were posted everywhere, as families searched for missing loved ones. Grief, shock and outrage filled the air. Some left. Some stayed.

This information is for those who stayed; the NYC Survivor, an NYC Responder & an NYC Participant (Last week post) who stood their ground by continuing to dwell in Lower Manhattan, unknowingly breathing in carcinogenic toxins in the air. Many have now become seriously ill.  

Ten years after the 9/11 terrorist attacks, and an entirely new crop of victims had emerged. Paul Simon serenaded a captive worldwide audience during the ten year memorial at the museum that now stands as a testament to the attack. One had to wonder if he was referring to the latent 9/11 illnesses, of those who were injured  post 9/11, when he sang these ominous words during his heartfelt acoustic rendering of The Sound of Silence; “Fools, say I, you do not know. Silence like a cancer grows.”

Not only Cancer. There are more Qualifying Condition for a 9/11 latent injury/illness.

Meanwhile, the clock continues to tic against the right to file any future claim.  In order for the claim of a participant in World Trade Center rescue, recovery or cleanup operations to come within the application of Article 8-A of the Workers' Compensation Law, the participant is required to register with the Workers' Compensation Board not later than September 11, 2018.

Here is a brief description of what is considered a “Qualifying Condition” according to the Workers’ Compensation Board World Trade Center Registration Form;

  •  A "qualifying condition" is defined as "any of the following diseases or condition resulting from a hazardous exposure during participation in World Trade Center rescue, recovery or clean-up operations:*

Here is another partial list describing “Qualifying Conditions” as per the New York State Workers’ Compensation Board WTC Registration Form:

(c) Diseases of the gastroesophageal tract, including esophagitis and reflux disease, either acute or chronic, caused by exposure or aggravated by exposure.

(d) Diseases of the psychological axis, including post-traumatic stress disorder, anxiety, depression, or any combination of such conditions.

(e) New onset diseases resulting from exposure as such diseases occur in the future including cancer, chronic obstructive pulmonary disease, asbestos-related disease, heavy metal poisoning, musculoskeletal disease and chronic psychological disease.
